What is Verification Against EU Law?

Verification against EU law is the process by which the Dutch Immigration and Naturalisation Service (IND) checks whether your right to reside in the Netherlands is guaranteed under EU treaties and directives. It applies mainly to:

  • EU/EEA citizens exercising free movement rights.

  • Family members of EU citizens (including non-EU nationals).

Instead of granting a traditional residence permit, the IND “verifies” your right to live in the Netherlands under EU law.


The Legal Basis

The key foundation for verification is Directive 2004/38/EC, also known as the Free Movement Directive. It gives EU citizens and their families the right to move and reside freely within the EU. Dutch law implements this directive through national regulations, ensuring that the Netherlands aligns with EU obligations.
